DMCA & Copyright Policy

1. Overview

Fluxorus Networks, LLC respects intellectual property rights and responds to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA) and similar laws. This policy is part of our Acceptable Use Policy.

3. Filing a Notice

A valid takedown notice to our Designated Agent must include:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location (URL/IP)
• Your contact information (name, address, phone, email)
• A statement that you have a good-faith belief the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act

4. Counter-Notification

If your material was removed and you believe this was a mistake or misidentification, you may send a counter-notification to our Designated Agent including your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake, and your consent to the jurisdiction of the federal court for your district (or the Southern District of New York if outside the U.S.). We may restore the material in 10–14 business days unless the complainant files a court action.

5. Repeat Infringers

In appropriate circumstances, Fluxorus will suspend or terminate the accounts of customers who are repeat infringers.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please do not make false claims.
