Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines prohibited uses of Fluxorus Networks, LLC services. It is incorporated by reference into our Terms of Service and applies to every customer and to anyone who uses the services through a customer's account, including the customer's end users. Customers are responsible for their end users' compliance. Violations may result in suspension or termination without refund.

2. Prohibited Activities

2.1 Illegal Activities & Content

  • Any activity that violates local, national, or international law
  • Child sexual abuse material (CSAM): zero tolerance — reported to authorities as described in Section 6
  • Distribution of copyrighted or pirated material without authorization
  • Hosting or distributing malware, viruses, or malicious code
  • Terrorist content, incitement to violence, or unlawful weapons sales
  • Fraud, phishing, carding, or sale of stolen data or credentials
  • Use prohibited by export-control or economic-sanctions laws, or by sanctioned parties

2.2 Network Abuse

  • Port scanning, network probing, or unauthorized access attempts
  • Launching or participating in DoS/DDoS attacks (outbound attacks of any kind)
  • Operating amplification/reflection vectors, open DNS resolvers, open NTP/SSDP/memcached, or open mail relays
  • Hosting botnet command-and-control, stressers/booters, or attack infrastructure
  • IP spoofing, route hijacking, or forging network traffic
  • Cryptocurrency mining without prior written authorization

2.3 Email Abuse

  • Sending unsolicited bulk email (spam) or violating CAN-SPAM or similar laws
  • Phishing or fraudulent messaging
  • Email harvesting or operating open relays
  • Exceeding reasonable outbound sending limits; outbound port 25 may be restricted by default

2.4 Proxy & Anonymization Abuse

  • Operating open proxies or abusing residential/anonymizing proxy services
  • Using the services to mask the origin of abusive or illegal traffic

2.5 Game-Server Abuse

  • Distributing cheats, exploits, or DDoS tooling targeting game services
  • Hosting pirated, leaked, or unlicensed game builds or server software
  • Running software in violation of a game publisher's terms

3. Resource Usage

  • Use resources within allocated limits and consistent with our Fair Use Policy
  • Avoid processes that degrade host performance for other customers
  • No reselling without authorization
  • Cryptocurrency mining requires prior written authorization (email support@fluxorus.com)

4. Customer Responsibility

You are solely responsible for all content and conduct on your services and for your end users. Fluxorus does not pre-screen or monitor customer content but may remove content or suspend services to comply with law, respond to abuse, or protect the network. You agree to indemnify Fluxorus for claims arising from your content or conduct, as set out in the Terms.

5. Enforcement

Depending on the severity of the violation, Fluxorus may take any of the following actions, with or without notice:

  • Issue a warning and require remediation
  • Immediately suspend, null-route, or disable the affected service or IP without prior notice to stop active abuse, attacks, or illegal content, or to protect the network and other customers
  • Remove or disable access to offending content
  • Terminate the account for serious, repeated, or willful violations

No refunds are provided for services suspended or terminated for AUP violations. You remain liable for fees and for any costs we incur responding to your violation.

6. Law Enforcement & Legal Process

Fluxorus cooperates with law enforcement and responds to valid legal process as described in our Law Enforcement Guidelines. We may preserve and disclose account data where required by law or to protect our rights, users, or the public. Apparent child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC) and/or relevant authorities, and related data is preserved as required by law.

7. Reporting Abuse

Report abuse, attacks, or illegal content to abuse@fluxorus.com. Please include relevant logs, timestamps (with time zone), and IP addresses so we can investigate quickly.

8. DMCA & Copyright

Fluxorus responds to copyright notices under the Digital Millennium Copyright Act (DMCA) and similar laws. To submit a takedown notice or counter-notice, and for our registered designated agent's contact details, see our DMCA & Copyright Policy. Repeat infringers' accounts will be terminated.

9. Changes to This Policy

We may update this AUP from time to time to address new forms of abuse or legal requirements. Material changes will be reflected in the "Last updated" date above, and continued use of the services constitutes acceptance.
