Fair Use Policy

1. Purpose and Scope

Our Fair Use Policy is designed to maintain the integrity, availability, and performance of our network infrastructure, ensuring an optimal experience for all hosting service customers. This policy specifically addresses data usage and total bandwidth consumption — in both inbound (ingress) and outbound (egress) directions — to promote fair and responsible service utilization.

Policy Objectives

  • Maintain optimal network performance for all customers
  • Ensure fair resource distribution across shared infrastructure
  • Prevent service degradation caused by excessive resource consumption
  • Support legitimate business operations within reasonable parameters

2. Bandwidth Usage Guidelines

Customers are permitted to utilize the available bandwidth of their Fluxorus service (VPS, VDS, dedicated server, game server, or CDN) within reasonable limits that support legitimate service purposes. These purposes include:

Website Hosting

Standard web traffic, content delivery, and dynamic page serving

Application Support

API services, SaaS platforms, and business applications

Email Traffic Management

Business email, transactional messages, and notifications

Standard Operations

Database replication, backups, and legitimate data transfers

Additional Bandwidth

Each plan includes a defined monthly transfer allowance covering both inbound and outbound traffic. Additional bandwidth beyond that allowance is available on request: additional usage up to 20 TB is granted without formality, while requests that exceed 20 TB require a brief written business justification so we can validate the workload and plan capacity accordingly. This threshold applies across all plans covered by this policy.

3. Reasonable Use Principles

The policy emphasizes the following core principles:

Outgoing Bandwidth

Outgoing bandwidth usage is subject to fair use monitoring to ensure network stability. While we provide generous allocations, excessive usage that impacts other customers may be subject to review and potential throttling.

Incoming Traffic

Inbound (ingress) traffic is measured and counts toward your bandwidth allocation alongside outbound usage. We track total data transferred in both directions to ensure fair and accurate resource accounting across shared infrastructure.

Prohibited Usage

Excessive bandwidth consumption that potentially disrupts service for other users is strictly prohibited. This includes but is not limited to continuous line-rate saturation, torrent seeding at scale, and unauthorized commercial CDN operations.

4. Bandwidth Consumption Parameters

We reserve the right to continuously monitor data usage across all hosted services to ensure strict compliance with our Fair Use Policy. This monitoring helps us:

  • Identify potential misuse: Detect patterns inconsistent with legitimate business operations
  • Protect network performance: Prevent individual services from monopolizing shared resources
  • Maintain service quality: Ensure consistent performance across our entire customer base
  • Optimize infrastructure: Plan capacity expansion based on genuine usage trends

5. Resource Usage Standards

5.1 CPU and Memory

VPS plans allocate specific CPU cores and RAM. Fair use means:

  • Using resources within your allocated limits
  • Avoiding sustained 100% CPU usage without upgrading to appropriate tier
  • Not running processes that degrade host node performance for other customers
  • Cryptocurrency mining requires explicit written authorization

5.2 Storage and IOPS

Storage is allocated per plan specifications. Fair use includes:

  • Active data for running applications and websites
  • Reasonable log retention (recommended 30-90 days)
  • Temporary build and cache files with regular cleanup
  • Avoiding sustained maximum IOPS that impact shared storage systems

6. Monitoring and Enforcement

We maintain continuous oversight of our network infrastructure to ensure compliance with our Fair Use Policy and to maintain optimal service quality for all customers.

Usage Monitoring

Our monitoring systems actively track bandwidth usage and system performance to identify any potential violations of our Fair Use Policy. This proactive approach helps us maintain service quality and prevent disruptions.

What We Monitor

  • Inbound (ingress) and outbound (egress) bandwidth consumption and patterns
  • Network flow analysis (metadata only, not content)
  • Host node resource utilization and performance metrics
  • Automated alerts for resource anomalies and excessive usage

7. Breach Response Mechanisms

In instances of policy violation, we may implement the following corrective actions:

Warning Notice

Email notification with usage details and 48-hour remediation period to address the issue

Bandwidth Limitation

Temporary throttling of outbound traffic to protect network performance for other customers

Upgrade Recommendation

Suggestion to move to a more appropriate plan tier or dedicated infrastructure

Service Suspension or Termination

For severe, repeated, or willful violations that impact service quality for other customers

8. Commitment to Fair Service

Our Fair Use Policy is not intended to restrict legitimate business operations but to ensure a balanced, high-performance hosting environment that serves the collective interests of our customer community.

Legal Effect & Administration

  • This Fair Use Policy is incorporated by reference into our Terms of Service and Acceptable Use Policy, and applies to all Fluxorus services.
  • Fluxorus reserves the right to rate-limit, throttle, or suspend a service to protect network stability and other customers.
  • Throttling or suspension applied under this policy does not count as downtime and is excluded from service credits under our Service Level Agreement.
  • Fluxorus's usage measurements are the authoritative record for fair-use purposes; we are not liable for monitoring-related estimates.
  • We may update this policy with notice as described in the Terms; continued use after the effective date constitutes acceptance.
